What's Worn Terms Of Use
OVERVIEW
These Terms of Use ("Terms") govern your use of whatsworn.com (the "Site"), which is operated by What's Worn ("we", "us", "our"). Throughout the Site, "you" refers to the person accessing or using the Site.
What's Worn is an independent informational website. We research and publish which football boots, footwear and related gear professional athletes wear, and we explain how that gear is designed and why it performs the way it does. We are not an online store. We do not sell products, we do not accept orders, and no contract of sale is formed between you and us by using this Site. Where we show you a product, that product is sold by a third-party retailer on the retailer's own website, under the retailer's own terms.
By using the Site you agree to be bound by these Terms. If you do not agree with them, please do not use the Site. If you are under 18 years of age, you must have the consent of a parent or guardian to accept these Terms.
AFFILIATE DISCLOSURE AND HOW WE MAKE MONEY
What's Worn is free to use, and we earn money from the links on this Site.
Many of the pages on the Site contain links to retailers and brands. When you click one of these links and go on to buy something, the retailer may pay What's Worn a commission. This is called an affiliate link. We participate in affiliate programmes with retailers and affiliate networks, including Commission Factory and Impact.com, through which these links are tracked and attributed.
To be completely clear about what this means for you:
- The price you pay is the same whether or not you came through one of our links.
- We do not add any mark-up, fee or "affiliate price" to anything.
- We only earn if you choose to buy something, and we never receive a larger commission for pressuring you to do so.
- Our editorial content, our ratings, and which athletes we cover are not for sale and are not influenced by any affiliate relationship. We will tell you if that is ever not the case.
The commercial relationships that fund the Site are the reason it can exist. We think it is only fair that you know about them, so we have put this section near the top rather than burying it.
THIRD-PARTY LINKS, RETAILERS AND THEIR TERMS
The Site contains links to websites we do not control and are not affiliated with, including retailer websites, brand websites, and social media platforms. If you follow a link out of the Site, you are on a third party's site and their terms apply, not these Terms.
In particular, and without limitation:
- Any purchase, contract, payment, delivery, warranty, return, exchange or refund is between you and the retailer, not with us. We are not a party to that transaction and cannot assist with it. Direct any order, delivery or warranty enquiries to the retailer.
- Prices, discounts, stock levels, product variants and availability shown or linked from the Site are set by the retailer and are subject to change without notice. Where we show an indicative price, it is a guide only and may be out of date, differ by size, colour or customer, or differ from the price the retailer actually charges you. Always confirm the current price on the retailer's site before you buy.
- We do not endorse, warrant or make any representation about any third-party product, service, website or content, and we have no control over it.
- Links may point to a retailer's general category page rather than an exact product where we could not confirm a current product page. We are not responsible for what you find once you leave the Site.
- We are not liable for any loss or damage arising from your use of, or reliance on, any third-party website, product or service.
Any use of the brands, product names, team names, league names, competition names or athlete names on the Site is descriptive and editorial only. All such names, logos and trade marks belong to their respective owners. Nothing on the Site grants you any right to use them, and no trade mark or other intellectual property right is implied or licensed. We are not affiliated with, endorsed by, sponsored by, or acting as an agent of any athlete, team, league, competition, retailer or brand named on the Site.
NO RELIANCE ON CONTENT
Everything on the Site is provided for general information and interest only. It is not professional advice, and it is not a recommendation to buy or not to buy any particular product.
Athlete footwear changes frequently, and we may not have verified a page recently, or at all. Product descriptions, ratings, comparisons and features may be incomplete, out of date or simply wrong. We correct things when we find them, but we cannot guarantee the accuracy, completeness or currency of anything on the Site.
You use the Site, and any decision you make based on it, entirely at your own risk. If you rely on what we publish and it turns out to be wrong, we are not liable for the consequences.
YOUR USE OF THE SITE
You may read, print and share our content for personal, non-commercial use. You may not, without our written permission:
- Republish, mirror or scrape substantial portions of the Site, whether by hand, by script, by crawler or otherwise. Automated scraping and crawling are expressly prohibited.
- Use the Site or any part of it to build, train or improve any dataset, model or machine-learning system.
- Copy our editorial content, product descriptions, ratings, images, database or design and present it as your own, whether or not commercially.
- Remove or obscure any copyright, attribution or disclosure notice.
- Use the Site, or our name or branding, in a way that suggests we endorse you, a product, a retailer or a candidate.
- Do anything unlawful, or that interferes with the Site or its other users, including attempting to gain unauthorised access or introducing malicious code.
You keep all ownership of content you send us. If you send us a correction, a suggestion or a contribution, you give What's Worn a non-exclusive, worldwide, royalty-free licence to publish it, without attribution being required, and you confirm you have the right to send it.
INTELLECTUAL PROPERTY
The What's Worn name, logo, site design, layout, code, database of athlete and product information, editorial content, ratings and underlying compilation are owned by What's Worn or our licensors, and are protected by copyright and other intellectual property laws. Except for the personal, non-commercial use described above, all rights are reserved.
If you believe something on the Site infringes your rights, contact us and we will look into it promptly.
NO ACCOUNTS
The Site does not currently require you to register an account, and it has no user-generated content features such as reviews, comments or ratings submitted by visitors. Any rating or score shown on the Site is our own editorial assessment, not a summary of customer reviews. If that changes, we will say so.
THIRD-PARTY SERVICES
The Site may load content or services from third parties, including analytics, tag management, email and error-reporting providers. Those providers act on their own privacy terms, and we do not control them. Loading them is subject to your consent where we ask for it, and to the consent choices you have made in your browser.
DISCLAIMER AND LIMITATION OF LIABILITY
The Site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that any information obtained from it will be accurate or reliable.
To the fullest extent permitted by law, What's Worn and its directors, officers, employees, agents and contributors are not liable for any loss, injury, claim, cost or damage of any kind (including indirect, incidental, special, consequential or exemplary damages, or lost profits, revenue or data) arising from your use of, or inability to use, the Site or anything you access through it, or from your reliance on anything published on it.
Nothing in these Terms excludes, limits or modifies any right, remedy, obligation or liability that cannot lawfully be excluded, limited or modified. In particular, nothing limits your rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including the consumer guarantees, your right to be given goods of acceptable quality, and your right to a remedy for goods that are not of acceptable quality. Where you are a consumer under the Australian Consumer Law, our liability for any goods or services supplied is limited to the extent permitted by that Act.
INDEMNITY
You agree to indemnify What's Worn against any claim, demand, loss or expense (including reasonable legal costs) arising from your breach of these Terms, your unlawful use of the Site, or your infringement of any third party's rights.
SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Terms is found to be unenforceable, it will be read down to the minimum extent necessary, or severed, without affecting the rest of these Terms. Your failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and What's Worn about your use of the Site, and replace any earlier version of them.
CHANGES TO THESE TERMS
We may update these Terms by posting the new version on this page. The date at the top of this page shows when they were last revised. Your continued use of the Site after a change is posted means you accept the updated Terms. If you disagree, please stop using the Site.
GOVERNING LAW
These Terms and your use of the Site are governed by the laws of Australia. By using the Site you submit to the non-exclusive jurisdiction of the courts of Australia. We will ordinarily resolve disputes informally by email before commencing proceedings, and nothing in these Terms limits your right to pursue a remedy available to you under the Australian Consumer Law.
